Terms of Service

These Terms of Service govern your access to and use of services offered by KAKEL Enterprises LLC ("KAKEL", "we", "us") through kakel.io, including PhoneToolkit, Companion, PrivacyGuard, KMSES, Device Risk API, Orphan Tracker, and any related products (collectively, the "Services").

1. Eligibility

KAKEL Tech Services are offered for use by licensed dealers, authorized repair operations, engineering teams, and equivalent business users. By using paid Services, you represent that you are operating in a commercial capacity and that you own or are authorized to operate on every physical device against which you run a recipe or workflow. Use of the Services to bypass owner consent, defeat security measures on devices you do not own, or evade lawful process is strictly prohibited and constitutes immediate grounds for termination.

2. License keys and activations

Paid Services are activated by license keys bound to specific machines. Sharing a license key with parties not employed by your business is a breach of these Terms. KAKEL reserves the right to revoke any license that shows evidence of abuse, including but not limited to use on machines beyond your purchased seat allotment.

3. Acceptable use

You agree not to: (a) attempt to bypass Activation Lock, FRP, iCloud Account Lock, or any carrier lock on a device for which you cannot demonstrate ownership or owner authorization; (b) use the Services to facilitate trafficking of stolen devices; (c) misrepresent yourself or your business; (d) attempt to reverse-engineer the Services to redistribute or compete; or (e) violate any applicable telecom, consumer-protection, or data-protection law.

4. Recipes and outcomes

KAKEL Tech tools execute documented recipes. We do not promise unlock success on any specific device. Recipe success depends on device firmware version, carrier policy, OEM updates, and variables outside our control. PhoneToolkit explicitly does not bypass Activation Lock — it detects and documents it.

5. Subscriptions, refunds, lifetime licenses

Monthly and annual subscriptions auto-renew through Stripe; you may cancel at any time via the billing portal. We offer a 14-day refund window from initial purchase on monthly and annual subscriptions if recipes do not work on your hardware as documented. Lifetime licenses are non-refundable after first activation. Lifetime includes 1 year of OS-compatibility updates from purchase date; an optional $99/year maintenance plan extends update coverage thereafter.

7. Liability

To the maximum extent permitted by law, KAKEL's aggregate liability arising from your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages, including lost profits, data loss, or business interruption.

8. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. KAKEL Enterprises LLC is a Delaware-registered limited liability company.
